Terms & Conditions

  • Scope of the contract

    The following General Terms and Conditions govern the contractual relationship between the seller Laudin Internationaler Handel GmbH, Rostock-Koppel 37 A, 25365 Klein Offenseth-Sparrieshoop, Germany and the respective buyer on the eBay sales platform on the Internet.

  • Subject matter of the contract

    The subject of the respective contract is the sale of goods by the seller to the buyer on the eBay sales platform, in particular the sale of used car parts.
    These goods are offered by the seller either through their eBay store as shop items or as general auction items. General auction items are visible on both the general eBay sites and the seller's eBay store.
    The offers of goods posted on the general eBay websites or in the seller's eBay shop are binding offers by the seller to conclude a purchase contract for the respective item.

  • Conclusion of contract, contract language

    The buyer can buy goods offered via the seller's eBay shop immediately or bid on these goods as part of an auction. Auction listings may also be associated with the Buy It Now option. The merchandise offered on the seller's eBay store in the Buy It Now offer format and auctions of these goods are also visible on the general eBay websites. This does not apply to shop items of the seller.
    In the case of instant purchase, an effective purchase contract is concluded between the buyer and seller at the buy now price (fixed price) when the buyer clicks on the "Buy now" or "Immediately & New" button and then confirms. For fixed-price items where the seller has selected the "immediate payment" option, the buyer accepts the offer by clicking on the "Buy It Now" button and completing the immediately following payment process. The Buyer may also accept offers for multiple items by adding the items to the shopping cart (if available) and completing the immediately following payment process. Listings with the "Buy It Now" option can also be purchased by the buyer as a guest without having to log in to eBay. In this case, the buyer accepts the offer by clicking on the "Buy it now" button, selecting the option "Continue as guest" on the following login page and completing the immediately following payment process.
    In the case of an auction, an effective purchase contract is concluded with the buyer who has submitted the highest bid within the offer period. The amount of the purchase price is based on this highest bid. A bid expires if another buyer submits a higher bid during the listing period.
    If an auction offer is also provided with the Buy It Now option, an effective purchase contract for the purchase of the item is concluded at the Buy It Now price (fixed price), regardless of the expiry of the offer period and without an auction being held, if a buyer exercises this option. The option can be exercised by the buyer as long as no bid has been placed on the item or a minimum price, if any, set by the seller has not yet been reached.
    If the seller provides his offer with a price suggestion function, the buyer and seller can negotiate the price for this item. The submission of the price proposal by the buyer is then the binding offer and the seller's consent to the price proposal is the binding acceptance of the seller.
    After the conclusion of the contract, the seller will send the buyer a confirmation and details of the purchase process.
    The contract language is exclusively german. The text of the contract is not stored by the seller and can no longer be retrieved after completion of an order process (e.g. "Buy now"). However, the buyer can save or print out the order data immediately before sending it using the functions of his browser.
    The new payment processing supports an improved buying and selling experience on eBay. It provides sellers on eBay with a single place to sell and access information about their payments, resolve dispute and buyer protection cases, and manage refunds. The seller is notified by eBay that the item has been sold and has been paid for. The item is shipped and eBay initiates the payouts to the bank account, regardless of how the buyer paid.

  • Right of revocation

    If the buyer is a consumer, he is legally entitled to a 14-day right of withdrawal. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.
    Information on the right of withdrawal can be found in the respective item description of the seller. After conclusion of the contract, the buyer will also receive an order confirmation with instructions on his right of revocation and information on how to exercise it, e.g. via the sample revocation form attached to the revocation instruction.

  • Return or cancellation of purchase

    If the buyer is entitled to a refund for a return or abandonment of a transaction for which we are processing the payment, you agree that we will reimburse the buyer on your behalf for the amounts paid by the buyer for the transaction in question, or that you must instruct us to reimburse the buyer in accordance with eBay's Return Process Principles. You can trigger a refund to your buyer through the seller portal.

  • Warranty, liability

    The warranty of the seller in the event of a defect in the goods as well as the liability of the seller for damages is governed by the statutory provisions.

  • Final provisions

    These General Terms and Conditions and the respective concluded purchase contract shall be governed exclusively by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In the event that the buyer is a consumer, this shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.
    Should one or more clauses of these terms and conditions be invalid in whole or in part, this shall not affect the validity of the remaining provisions.

  • Information on Alternative Dispute Resolution

    The EU Commission provides an online platform for dispute resolution ("OS platform"), which can be reached via the link http://ec.europa.eu/odr. If the customer is a consumer residing in the European Union, it is possible to use this platform for the out-of-court settlement of disputes about contractual obligations arising from online sales contracts.
    The seller is not obliged to participate in a dispute resolution procedure before a consumer arbitration board and is generally not willing to do so.
